The following terms and conditions are intended to define the legal framework that will apply to the relationship between :

- and any person visiting or making a purchase from the www.mineraljoaillerie.com website.

Their purpose is to define the reciprocal rights and obligations of both parties during the various stages of ordering one or more items.
Any person registering on the site must adhere to these general conditions of sale and thus accept them unreservedly.

Partial invalidity
The present conditions express the entirety of the obligations of the parties.
Should any condition be missing, it will be considered as being governed by current practice in the distance selling sector.
If a particular stipulation of the present conditions is held to be invalid or declared as such by a res judicata decision of a competent jurisdiction (change in legislation, regulations, court decision), the other stipulations will retain their full force and scope.

Limitation of clientele
The items displayed on the site are offered for sale to non-trading individuals only.
All users of the site declare that they have the legal capacity to place an order on the site and to use a bank card.

Mineral joaillerie sells the products present on its distance selling website only to end consumers. Mineral joaillerie reserves the right to limit the quantity of products delivered to any one buyer or postal address. ARTICLE 1: PRODUCT AND AVAILABILITY

The mineraljoaillerie.com website manufactures and sells ecogold-certified 18-carat gold jewelry.
The products sold are photographed, retouched and described as accurately as possible.
The products sold are those described and visible on the site. Mineral joaillerie reserves the right to withdraw from sale, at any time, any item displayed on mineraljoaillerie.com and/or to replace or modify any information associated with the items displayed on this site.
The illustrative photos used on our site come exclusively from our photo shoots.

ARTICLE 2: ORDERING

All orders imply an obligation to pay.
Orders are received exclusively via the Internet after acceptance of these general terms and conditions of sale. To place an order on the www.mineraljoaillerie.com website, you may or may not be registered. Upon registration, you will be given a login and password.
All orders are subject to prior acceptance by Mineral joaillerie and are only definitively confirmed once the customer has received an e-mail confirming shipment of the item(s).
Data relating to orders are stored on computer media. They are considered as proof of the contractual relations between the parties in the same way as any document drawn up, received or kept in writing.

ARTICLE 3: PAYMENT

All orders require payment by credit card, Paylib, Paypal or Alma.
On the www.mineraljaoillerie.com website, payment for purchases is made at the time of order, either by credit card, Paylib or Paypal, or in 2 or 3 instalments, free of charge, with Alma.
For credit card / Paypal payments, we debit your credit card at the time of ordering.
Paypal payments are also debited at the time of order.
Secure payment by credit card is made via the Sogecommerce platform by Société Générale, guaranteeing perfect payment security.
Payment in 2 or 3 free instalments with Alma is valid for a minimum amount of 200€. The buyer will be charged the same amount over 2 or 3 consecutive months, depending on the option chosen.

3D Secure program
To enhance transaction security, Mineral joaillerie has implemented the 3D Secure program.
This is a program created by international issuers Visa (Verified By Visa) and Mastercard (Mastercard Secure Code) to enhance the security of online payments. In addition to bank details, the purchaser is asked to enter personal data enabling the bank to identify the purchaser and validate the transaction.

Authentication methods are specific to each bank. If a cardholder does not have an authentication code, he/she should contact his/her bank.

ARTICLE 4: PRICES

The prices displayed on the site are in euros, inclusive of all French taxes (French VAT and other taxes applicable on the day of the order) and exclusive of shipping and handling costs. Delivery costs are indicated before the order is validated.

Orders from the UK, Switzerland and French overseas departments and territories are exempt from French VAT (20%). The calculation is done automatically in the order process as soon as the billing and delivery address is entered.

All orders, whatever their origin, are payable in euros. The mineraljoaillerie.com site reserves the right to modify its prices, but products will be invoiced on the basis of the rates in force at the time orders are registered.

ARTICLE 5: DELIVERY AND ACCEPTANCE

How are items delivered?
Packages are delivered by La Poste using the "Colissimo suivi" service, with the option of a signature. This digital signature and its reproduction are proof of delivery of the parcel.

Delivery
You are free to choose where you would like your order to be delivered:

  • At the address of your choice (home, office...).
  • At any of the 10,000 post offices.
  • At one of the many retailers in La Poste's partner network.

The different delivery options are offered to you when you finalize your order basket.

For Colissimo parcels delivered to the address of your choice, if the recipient of the parcel is absent at the designated address, a delivery notice is left in the recipient's letterbox. This notice indicates the address of the post office or relay point where the recipient can collect the parcel. Any parcel thus placed on hold is handed over to the addressee or to his or her duly authorized representative on presentation of proof of identity and against signature. The parcel will be held for 15 consecutive days from the day after the notice is deposited.

In the event of errors or inaccuracies in the purchaser's contact details or delivery to a company, Minera joaillerie cannot be held responsible for the impossibility of delivering the order.

What are the delivery times?

For France:
As soon as your c is sent, La Poste undertakes to do everything in its power to ensure the delivery of the items or the first delivery notice for items entrusted to it. Delivery times should not exceed one month.

Some products (in particular jewelry) are made to order from the supplier and are indicated as such in the product description. A delivery time will be indicated in the basket. The waiting period should not exceed 8 weeks.

When the parcel is dispatched, the buyer will receive an e-mail confirming that the parcel has been sent, with a tracking number on the www.laposte.fr website for Colissimo.

For other countries, outside the EU :
Deliveries are made with FedEx. Delivery times range from 1 to 10 working days, depending on the delivery method chosen and the destination.

Delivery problems
If the original packaging is damaged, torn or open at the time of delivery, we strongly recommend that you check the condition of the items in the presence of the delivery person and immediately make any reservations on the delivery note, or even refuse the parcel.

We strongly recommend that you systematically check the contents of the parcel in the presence of the carrier, in order to verify the condition of the items, even if your parcel shows no signs of damage. If they have been damaged or stolen, you must refuse the package and note a reservation on the delivery slip (package refused because opened or damaged).

To obtain a refund, the buyer must inform us of any problem by sending us a message via the "Contact" section. The problem must be described in detail (e.g. damaged, already opened, etc.). The buyer may be asked to provide a photo of the damage by e-mail.

In the event of non-delivery of the parcel by the Post Office, the buyer must inform us via "Contact". We will then open an investigation with the services concerned. You will receive an e-mail indicating that an investigation has been opened. Final response times from the Post Office vary from 4 to 6 weeks. If the parcel is found, it will be sent to the customer according to the usual procedure. If the parcel is declared lost and there is no stock available for a second shipment, the order will be reimbursed as soon as possible.

ARTICLE 6: RETURNING PRODUCTS

Returns are at the customer's expense. After payment of the return costs, we will send you the corresponding label.
All returns will be refunded according to your method of payment. Refunds will be made within 30 days of receipt of your return.
If you have made a purchase with a promotional code, this code cannot be reused in the event of a return, even if you wish to take back the same product.

In accordance with the provisions of articles L121 et seq. of the French Consumer Code, each user of the site has a cooling-off period of 14 days from receipt of his or her package to return one or more items, at his or her expense and risk, without having to justify the reason.

In case of payment with a credit (e-gift card), the return will generate a credit of this credit. Refunds are incompatible with this method of payment. Returns that do not comply with our policy will not be accepted and will be returned to you.

We also offer a resizing service at the buyer's expense.

ARTICLE 7: WARRANTIES

Within the framework of the legal guarantee of conformity, mineral joaillerie undertakes, at the Purchaser's option:

  1. Or replace the product with an identical one, subject to availability,
  2. Or to refund the price of the product if the replacement of a product proves impossible.

Within the framework of the legal warranty for hidden defects, mineral joaillerie, at the Buyer's option, undertakes, after evaluation of the defect :

  1. Or refund the full price of the returned product,
  2. Or to refund part of the price of the product if the Buyer decides to keep the product

All cords on our bracelets are guaranteed for 2 years from the date of purchase. Only shipping costs are charged to the customer.
After this period, repair and shipping costs are at the customer's expense.

ARTICLE 8: INTELLECTUAL PROPERTY

All texts, comments, works, illustrations and images reproduced on mineraljoaillerie.com are reserved under copyright and intellectual property law. As such, and in accordance with the provisions of the French Intellectual Property Code, only private use is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code. Any other use constitutes an infringement and is punishable under the Intellectual Property Code. Any total or partial reproduction of sites published by Mineral joaillerie is strictly forbidden.

Mineral joaillerie retains full ownership of the products sold until full payment has been received, including all fees, taxes and compulsory contributions.

ARTICLE 9: PERSONAL DATA

All information provided during your visit to www.mineraljoaillerie.com is strictly confidential.

Mineral joaillerie undertakes not to divulge to third parties any personal information that you may communicate to us. This information is confidential. It will only be used by our internal services to process your order and to reinforce and personalize the communication and product offer reserved for Mineral joaillerie customers, in particular via the newsletter.

Consequently, in accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to any personal data concerning you.

To do so, simply send us an online request, indicating your full name, address and, if possible, your customer reference by e-mail or by filling in our contact form.

ARTICLE 10: LIABILITY

Mineral joaillerie cannot be held responsible for any inconvenience or damage inherent to the use of the Internet (service interruption, external intrusion, computer viruses, etc.).

ARTICLE 11: DISPUTES

Any dispute may be settled with our customer service department and, in the absence of an amicable settlement, the rules of jurisdiction will apply. However, mineraljoaillerie.com reserves the right to summon the customer to appear before the court in whose jurisdiction his domicile or registered office is located.

ARTICLE 12: FORCE MAJEURE

The performance by the company of all or part of its obligations will be suspended in the event of the occurrence of an act of God or force majeure which hinders or delays performance. The various cases recognized by jurisprudence are considered as such. In such an event, Mineral will notify its customers by email within 7 days.

ARTICLE 13: APPLICABLE LAW AND JURISDICTION

These terms and conditions of sale are governed by French law.

ARTICLE 14: CUSTOMS DUTIES

Any order placed on mineraljoaillerie.com and delivered outside mainland France may be subject to any taxes and customs duties that may be imposed when the package reaches its destination.

Any customs duties and taxes associated with the delivery of an item are your responsibility. We are not in a position to verify applicable customs duties and taxes.
